Who you are agreeing with

JobOps is provided by Lambda-Phi of San Jose, California ("Lambda-Phi", "we", "us"). These terms and the JobOps Privacy Policy govern your use of JobOps. You must be at least 18 years old and legally able to enter this agreement.

The service

JobOps provides job-search software and related features that may assist with discovering opportunities, evaluating fit, preparing materials, organizing communications, and researching roles. JobOps does not submit applications or send external messages on your behalf. Final submission and sending remain your responsibility. Features, supported services, limits, availability, and interfaces may change over time. You remain responsible for your job search and for reviewing information and materials.

Access and accounts

Access may be limited, invitation-based, paid, preview-only, or otherwise subject to eligibility and usage limits. An invitation or account is for the person or organization to which it is issued unless Lambda-Phi says otherwise. Keep credentials secure and promptly report suspected unauthorized use through the Lambda-Phi contact form.

Third-party accounts and services

JobOps may require or interoperate with third-party accounts, websites, software, or services that you choose to use. Those services remain governed by their own terms, policies, permissions, availability, and charges. Lambda-Phi does not control third-party services and, to the extent permitted by law, is not responsible for them or for restrictions, suspensions, changes, or other actions they may take concerning your account or use.

Fees, subscriptions, and billing

If JobOps offers paid access, the applicable price, billing interval, renewal terms, taxes, and material purchase terms are presented before you authorize a charge or otherwise made available in the purchase flow. Prices, plans, features, and eligibility may change for future purchases or renewal periods. You authorize applicable charges under the payment method and terms presented to you. Except where required by law or expressly stated at purchase, fees already charged are nonrefundable.

Acceptable use

Use JobOps only for lawful purposes and only with information, accounts, and materials you are authorized to use. Except to the extent a restriction is prohibited by law, do not misrepresent identity, qualifications, or authority; interfere with or disrupt the service; bypass access, security, rate, or usage controls; probe or test non-public interfaces or security controls without authorization; scrape or extract data outside authorized interfaces; reverse engineer or attempt to discover non-public protocols, methods, models, or technical behavior; introduce malicious code; resell or redistribute access; or use non-public previews, outputs, documentation, observations, or access to build, train, benchmark, or improve a competing product or service. We may suspend or terminate access when we believe these terms, the service, Lambda-Phi, or others are at risk.

Your content and permissions

You retain the rights you have in résumés, profiles, preferences, communications, files, instructions, and other content you provide or connect to JobOps. You grant Lambda-Phi a non-exclusive, worldwide license, sublicensable to service providers and contractors acting on our behalf, to host, reproduce, process, transmit, display, adapt, format, analyze, and otherwise use that content as reasonably necessary to provide, operate, personalize, secure, support, improve, and develop JobOps; fulfill your instructions; investigate problems; enforce these terms; and comply with law. This license is limited where applicable law or the terms governing data from a connected third-party service impose narrower restrictions. Feedback and non-public materials

Feedback, ideas, suggestions, and improvement proposals may be used by Lambda-Phi without restriction, attribution, or compensation. Lambda-Phi and its licensors retain all rights in JobOps, its marks, software, documentation, designs, methods, and non-public materials. Access to a preview, demonstration, invitation, or non-public feature does not transfer intellectual-property, trade-secret, or other proprietary rights.

Changes, suspension, and ending the service

Lambda-Phi may add, remove, modify, limit, suspend, repackage, price, or discontinue JobOps, a feature, a preview, or an account, subject to applicable law and any purchase terms that expressly apply. You may stop using JobOps at any time and may cancel recurring paid access using the controls made available for that purpose. Effects of cancellation, suspension, termination, data retention, and deletion are governed by the applicable purchase terms, the Privacy Policy, and applicable law.

Disclaimers

JobOps is provided "as is" and "as available." To the fullest extent permitted by law, Lambda-Phi and its affiliates, founders, officers, directors, employees, agents, licensors, contractors, and service providers (the "Lambda-Phi Parties") disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, noninfringement, availability, security, accuracy, completeness, reliability, and results. JobOps does not guarantee interviews, offers, employer responses, placement, timing, uninterrupted operation, preservation of data, or the availability or behavior of third-party services.

Limits on liability

To the fullest extent permitted by law, the Lambda-Phi Parties will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, opportunity, goodwill, revenue, employment prospects, or business. The aggregate liability of the Lambda-Phi Parties arising from JobOps or these terms will not exceed the greater of $100 or the amount you paid Lambda-Phi for JobOps during the three months before the event giving rise to the claim. Nothing here limits liability that cannot legally be limited.

Your responsibility and indemnity

You are responsible for your use of JobOps, information and accounts you connect, materials you submit, representations you make, and decisions you take. To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Lambda-Phi Parties from third-party claims, liabilities, damages, losses, and expenses arising from your unlawful use, your violation of these terms, your infringement or violation of another person's rights, or information, accounts, or materials you use without authority.

Governing law

California law governs these terms without regard to conflict-of-law rules. Any dispute that cannot be resolved informally must be brought in the state or federal courts serving Santa Clara County, California, and each party consents to that venue and jurisdiction, except where applicable law provides a right that cannot be waived.

Changes and contact

Lambda-Phi may update these terms by posting a revised version with a new effective date. Continued use after an update means you accept the revised terms. Questions and requests go through the Lambda-Phi contact form.
